Judge criticises decision to accept case in his court
Incident related to alleged assault in a pub
The sitting Naas District Court judge has criticised a decision to accept an assault case to be heard in that court.
Judge Desmond Zaidan was referring to the case which arose from an incident in which one man sustained a broken nose.
The incident occurred at a pub in the area after a fight broke out on August 13, 2022, Sgt Dave Hanrahan told the court.
Referring to a previous decision that the case could be heard at district court level, where the penalties are less robust than in the circuit court, Judge Zaidan said it was “beyond my understanding how this would be seen as a minor allegation by a judge or the Director of Public Prosecutions.”
Indicating that he will send the case to the circuit court, he said he is “110% sure it’s not a case to be heard here.”
