Man caught driving without licence or insurance has yet to sit theory test

The 26-year-old has been disqualified from driving after Donegal District Court heard he had not yet sat a test three years after the offence
A man caught driving without licence or insurance in Donegal Town has been fined and disqualified from holding a driving licence.
Lukasz Bichojlo, 26, of 6 Farmleigh Park, Donegal Town was before Donegal District Court on Monday, April 28.
A previous court sitting had heard that on June 3, 2022 on the Diamond, Donegal Town, Bichojlo was found to be driving without licence or insurance. He subsequently failed to produce a driving licence or insurance policy at a garda station.
The defendant had no previous convictions.
Judge Sandra Murphy said that the case had been adjourned for mitigation and sentencing, and to allow the defendant an opportunity to regularise his driving situation.
She asked: “Did he do the driving test?”
Solicitor Tom McSharry said: “He has booked the appointment for his theory test. He hopes to have a provisional licence to do lessons and get the full licence.
“He is working in a local sawmill. To have no licence causes difficulties. I know I am on shaky ground but I would ask the court to consider not disqualifying him.
“He has no previous convictions and has not been in trouble since.”
Judge Murphy said: “He has had three years to do his test. I adjourned it before to allow him to do that. He has had ample opportunity.
“He therefore wouldn’t fall under the category of the discretion of the court not to disqualify.
The judge imposed a fine of €250 and a two-year driving ban for the offence of driving without insurance, with the charge of driving without a licence taken into consideration.
