Probation Act for woman caught stealing from Letterkenny supermarket

'She has a series of health problems,' the woman's solicitor told Letterkenny District Court. 'She says there was significant fog on her brain about what she was doing and there can’t be a rational explanation'
The Probation Act has been applied in the case of a Letterkenny woman caught stealing items from a supermarket.
Noreen Mongan was before Letterkenny District Court charged with a theft from Dunnes Stores, Oldtown Road, Letterkenny.
Sergeant Jim Collins told the court that Mongan, a 54-year-old of Lios na Greine, Letterkenny, entered the drapery section of Dunnes Stores and placed items in a basket and attempted to leave the store.
Staff confronted Mongan who returned the items, which were valued at €67.75. The court heard that the items were recovered and resalable.
Sergeant Collins confirmed that Mongan was “contrite” when spoken to by Gardai.
Mongan has one previous conviction for theft, the court was informed.
Mr Rory O’Brien, solicitor for Mongan, asked the court to consider his client’s early guilty plea.
“She has a series of health problems,” Mr O’Brien said. “She says there was significant fog on her brain about what she was doing and there can’t be a rational explanation.”
Mr O’Brien said that matters such as this aren’t frequently occurring, notwithstanding she does have previous.
Noting that the items were fully recovered and noting that Mongan had suffered the loss of her sister, Judge Emile Daly said she would place the defendant under a Probation Bond for a period of 12 months.
