32-year-old man charged with assault, burglary and attempted criminal damage with the offences aggravated by domestic abuse

A man has been remanded in custody at Derry Magistrates Court charged with assault, burglary and attempted criminal damage with the offences aggravated by domestic abuse.

Michael McMahon, 32, of Clon Elagh in Derry was arrested on September 10 for breaching a number of previous bail conditions as well as a charge of burglary, assault on a female and criminal damage to a door on September 10.

The court heard that police were called to an ongoing domestic and the alleged victim told police the defendant had forced his way into her house and had been 'pushing and shoving' her.

He left and she claimed he took her mobile phone before returning some time later and she said he had used the phone to call the police not to come.

McMahon had left the scene by the time police arrived but was later arrested in his home, claiming that he had not been to the victim's house, telling police that he had been in his mother's house sleeping at the time.

Police opposed bail as this was not McMahon's first breach of his bail conditions. He has previously done so in February and April of this year.

Defence counsel Sinead Rogan said her client would maintain these were 'made up allegations' and asked for bail.

Bail was refused and McMahon was remanded in custody to appear again on October 5.
